Cobbs Agreement Definition

Killebrew allowed a judge to approve or reject a criminal agreement reached by the parties or a recommendation from the prosecutor, which was the result of negotiations between the parties. By requiring a judge who refuses a recommendation for a conviction by the Public Prosecutor`s Office to announce the sentence that would have been appropriate, that court also recognized the practical impossibility of expelling any judicial involvement in the trial. The opposite idea is that the judge will eventually impose a sanction. The legislator has granted the judiciary a wide margin of appreciation in sentencing and the judge must not abdicate this function by authorizing criminal conventions to review criminal procedure. .
